Welcome to the Macclesfield Business Directory (the "Website"), a local directory that compiles, categorises, publishes, and verifies business listings in the Macclesfield area.
1. Who we are and your agreement to these terms
1.1. The Website is operated by Phil Thomas Tech Ltd ("we", "us", "our"), through its product localbusinesswebsites.uk.
1.2. By accessing, browsing, registering, submitting a listing, or using the referral tools on the Website, you (the "User", "Listed Business", or "Subscriber") agree to these Terms. If you do not agree, please stop using the Website.
1.3. These Terms form a legally binding agreement under the laws of England and Wales. Claiming a profile or buying premium services requires a positive "click-to-agree" opt-in, which creates a direct contract between us.
2. Intellectual property and database rights
2.1. The design, source code, database structure, and search indexes of the Website belong to Phil Thomas Tech Ltd or its licensors.
2.2. Database right. The selection, verification, categorisation, and presentation of the business data on this Website represents a substantial investment of our resources and is protected by the sui generis database right under the Copyright and Rights in Databases Regulations 1997.
2.3. No scraping. You may not use automated tools — spiders, crawlers, scrapers, data-mining tools, or AI training scrapers — to systematically extract, copy, or republish listings from the Website. Systematic or repeated extraction of listings to build a competing directory infringes our database right, and we will enforce that right through the civil courts, including by seeking injunctions and damages.
3. Unclaimed and verified listings
3.1. Unclaimed listings. To make the directory useful from day one, we index publicly available business information from registers, search results, and maps under an "Unclaimed" status.
3.2. No affiliation. An unclaimed listing does not mean the business is associated with, sponsored by, or endorsed by us, or us by them.
3.3. Claiming, correcting, or removing. If you own or represent a listed business, you can claim the listing to manage it, or ask us to correct or remove it by emailing uklocalbusinessdirectory@gmail.com. We action valid correction or removal requests within 72 hours of receiving your email.
4. Request for Quote (RFQ) referrals
4.1. The Website lets consumers send service requests ("RFQs") to matching businesses.
4.2. Data minimisation. If an RFQ is sent to an unclaimed listing, we pass on only a generic, redacted summary of the request.
4.3. Full details on claim. The consumer's full contact details stay within our system and are released to the business only once it has claimed the listing, agreed to these Terms, and completed verification.
5. Premium listings, payments, and your consumer rights
5.1. Business and consumer status. These Terms mainly govern business-to-business dealings, but we recognise that sole traders and small partnerships may also have rights as consumers under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013. Nothing in these Terms removes statutory rights you have as a consumer.
5.2. Service standard. We provide paid listings with reasonable care and skill.
5.3. Automatic renewal. Paid recurring listings renew automatically. We email a reminder to your registered address at least 14 days before each renewal charge. You can cancel renewal at any time before that charge by emailing us or using your account settings; cancellation stops the next renewal and is not subject to a fee.
5.4. Your right to cancel a new purchase (cooling-off). If you buy a listing as a consumer, you have 14 days from purchase to cancel for any reason under the Consumer Contracts Regulations 2013. If you ask us to make the listing live during that period and then cancel, you agree to pay a proportionate amount for the time it was active; we refund the rest within 14 days of cancellation. If the listing has not gone live, you receive a full refund. We do not apply additional administrative charges to cooling-off refunds.
6. Acceptable use and content
6.1. Listed businesses must keep their profile information accurate, lawful, and consistent with their trading details.
6.2. We may reject, amend, or suspend any listing or review that is inaccurate, unlawful, infringes someone's rights, promotes illegal activity, or is abusive or defamatory. We exercise this discretion reasonably and, where practical, will tell you why.
7. Reviews and user-submitted content
7.1. Your responsibility. If you post a review, image, or other content, you confirm it is your own or you have the right to share it, it is accurate and honest, and it is not defamatory, offensive, or unlawful.
7.2. Licence to us. You grant us a non-exclusive, royalty-free licence to display, store, and reproduce your content on the Website for the purpose of operating the directory. You keep ownership of your content.
7.3. Reporting and takedown. If you believe a review or other content is defamatory, infringing, or otherwise unlawful, email uklocalbusinessdirectory@gmail.com with details. We will review the report and remove or amend content where appropriate. We host user content and are not the author of reviews posted by users.
8. Availability and accuracy
8.1. We aim to keep the Website available and its listings accurate, but we do not guarantee uninterrupted access or that every listing is complete or current. Listings, especially unclaimed ones, are compiled from third-party sources and may contain errors.
9. Liability and third-party dealings
9.1. We are a directory provider. We do not vet, warrant, or guarantee the performance, licensing, or safety of any business listed. Any contract you enter into with a listed business is strictly between you and that business, and we are not liable for disputes or losses arising from it.
9.2. Nothing in these Terms limits or excludes our liability for fraud or fraudulent misrepresentation, for death or personal injury caused by our negligence, or for anything else that cannot be excluded under law. Subject to that, our total liability to you is limited to the fees you have paid us in the 12 months before the relevant claim.
10. Changes to these terms
10.1. We may update these Terms from time to time. The "last updated" date shows the current version, and continued use of the Website after a change means you accept the updated Terms. For material changes affecting paid subscribers, we will give reasonable notice by email.
11. Governing law and jurisdiction
11.1. These Terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer, this does not deprive you of protections available under the law of your home nation within the UK.
